NanoGig Screen firmware: End User License Agreement

Version 1.0. Applies to NanoGig Screen firmware v0.4.0 and every later release.

Earlier releases keep their licences. v0.3.0 stays under the PolyForm Noncommercial License 1.0.0 (text); v0.2.0 and earlier stay under the MIT licence their README stated. This agreement does not change or withdraw any right granted for those releases.

1. Who we are

NanoGig Screen is made by NanoGig, an independent developer (“we”, “us”). Contact: [email protected].

2. What this covers

“The firmware” is the NanoGig Screen software for the supported ESP32 boards, as installed from the NanoGig portal or updated over Wi-Fi, with its documentation, its updates and any source code we let you see. “A license” is the right to run the firmware that you get by buying a license key, with a kit, or from us directly. It is bound to the chip of one board: the chip ID the portal’s installer and the screen’s Activate page show.

3. What you may do

With a license, we give you a personal, non-exclusive, worldwide right to install and run the firmware on the one board that license is bound to, for as long as the license is valid, including to play live and in the studio, privately or for money.

You may move a license to another board once yourself on the portal’s Install page; the first board then stops being licensed. For further moves, contact us.

4. What you may not do

Unless the law allows it despite this agreement, or we agree in writing, you may not:

  • copy, share, publish, sell or rent the firmware, its images or a license (the signed license data a screen stores), or install them on boards that have no license of their own;
  • remove, disable or get around the license check, or change the firmware to do so;
  • sell, rent or lend boards or services with the firmware on them, other than passing on your own board with its license (tell us, so the license can follow it).

Nothing here limits what the law lets you do regardless of an agreement, such as decompiling for interoperability under the rules that implement EU Directive 2009/24/EC.

5. Updates and the license check

The firmware checks its license when it starts, with no network needed, and with the portal when it is online (when you check for updates or activate it over Wi-Fi). It sends the portal only its chip ID. A license that was moved to another board or revoked stops working on the next online check. We offer updates for as long as we choose to and may stop; an installed version keeps working, and its license stays valid.

6. An unofficial product

NanoGig Screen is not made, endorsed or supported by Neural DSP Technologies. It works with the pedal by observing how the pedal communicates; a pedal firmware update can change or break what it does.

7. Refunds, withdrawal, warranty and liability

Try first, then buy. Without a license the firmware runs for 15 minutes after each power-on, so you can check that it works with your board and pedal before you buy.

Refunds and withdrawal. Your license is supplied as soon as its key is shown after payment: at checkout you expressly ask for that, and acknowledge that you lose your right of withdrawal then. Purchases are final, except that you get a refund if the firmware does not work on a supported board and we cannot make it work. This does not limit your rights under consumer law for faulty digital content.

Warranty and liability. The firmware is provided as it is. It writes to your pedal: back up your presets in Cortex Cloud first. To the extent the law allows, we give no warranty beyond what consumer law requires and are not liable for lost presets, settings or other data, damage to equipment or indirect loss. Nothing in this agreement limits rights you have under the consumer law of where you live.

8. Ending

This agreement ends for a board when its license is moved, refunded or revoked for a breach of section 4; the firmware then shows only its Activate page. Sections 4, 6 and 7 survive.

9. Other software in the firmware

The firmware includes software by others under their own licences, which this agreement does not change: among others ESP-IDF and Espressif’s components and libraries (Apache-2.0), FreeRTOS, lwIP, Mbed TLS, NimBLE, wpa_supplicant, newlib, LVGL, cJSON, Monocypher, and the Montserrat and Font Awesome Free fonts. Their licence texts and notices are in THIRD_PARTY_NOTICES.txt, which comes with every release, and on the portal at nanogig.app/legal/third-party.
